Work Opportunity Tax Credits
Pursuant to the Small Business and Work Opportunity Tax Act of 2007 and the American Recovery and Reinvestment Act of 2009, employers can qualify for a significant tax credit if they hire people the government has determined to have the most difficulty finding work, including: the disabled, ex-felons, food-stamp recipients of food-stamps, supplemental security income, or welfare, unemployed veterans and youth aged 16 to 24 who are not in school, not working and lacked the skills to get a job. In order to qualify for the tax credit program, employers must apply for the same via the employer's state employment office, complete the necessary forms to qualify (Forms 8850 and 9061) within 28 days of the employee's hire and once qualified, complete IRS Form 5884. While employers are encouraged to pursue this tax credit, they should consult with legal counsel to determine the best approach to solicit the information necessary to qualify for the credit without violating the applicable laws against discrimination or violating employees' privacy.
