GINA
Title II of the Genetic Information Nondiscrimination Act ("GINA") took effect November 21, 2009. GINA prohibits employers, unions, employment agencies from collecting genetic information, including family medical history, from employees or applicants. Additionally, no genetic testing is allowed. The Equal Employment Opportunity Commission ("EEOC") has revised its anti-discrimination poster to include a reference to GINA (as well as to address the changes to the American With Disabilities Act). Employers covered by federal law should update their workplace EEOC poster, revise their handbooks and policies to reflect this prohibition and to the extent appropriate, train supervisors and managers that genetic bias is now prohibited.
